Uganda: City hospital sued over magistrate Kobusheshe's death

Kampala, Uganda – 5th December, 2016: A city hospital, Case Medical Centre, has been sued for alleged professional negligence leading to death of Francis Kobusheshe, former Chief Magistrate of Kiboga and Hoima districts in December 2015.

Kobusheshe was declared dead on December 29, 2015, nine days after admission at Case Medical Centre.

It alleged that the relatives took the body to Makerere University's Department of Pathology for a post-mortem which indicated that a drainage tube was found extending to the deceased's brain stem which raptured the cerebral artery and caused blood leakage into the space between the two membranes surrounding the brain.

The case was filed before the High Court in Kampala.

Ms Harriet Kobusheshe, wife to the deceased, sued the hospital jointly with its employee Dr Hussein Senyonjo for alleged professional negligence leading to loss of life.

Through her lawyers, R. Mackay Advocates, Ms Kobusheshe contends that the conduct of Dr Senyonjo from the time of admission of the deceased amount to professional negligence as the methods adopted fell short of the conventional way of medical care.

The wife seeking special damages worth Shs38.3m as expenses incurred by the family and general damages for negligence and loss of life and expectation.

"The plaintiff shall aver and contend that the deceased would have engaged in gainful employment for government of Uganda for 13 years from time of death and a further 20 years upon retirement in private legal practice.

Hence, as a result of the death of the deceased, the family of the deceased has incurred loss of support and have been put to anguish, mental suffering and inconvenience for which they claim general damages," reads the suit.

Court has summoned both Dr Senyonjo and Case Medical Centre to file their defence within 15 days.

Investigations

At the requiem mass for the deceased held at Our Lady of Africa Catholic Church in Mbuya, Nakawa Division, the judiciary called for an investigation into Kobusheshe's death. "I endorse the call for thorough investigations into the circumstances that led to the death of our colleague," said Deputy Chief Justice Steven Kavuma.
