Medical Negligence Case Over Gallbladder Surgery Heads to Jury

A Kansas man who underwent gallbladder surgery more than two years before filing a medical negligence lawsuit against his surgeon must go to trial on the question of when he should have realized the organ hadn’t been removed, a federal court said.
Lance Hinnergardt wasn’t entitled to pretrial judgment rejecting Herbert Hoover’s defense that the patient knew enough to suspect medical malpractice within two years after the surgery, meaning that a jury must decide if Hinnergardt filed the suit too late, the U.S. District Court for the District of Kansas said.
