Delay in treatment and referral – Hospital held negligent

The patient experienced severe stomach pain. She visited the hospital; doctors diagnosed uterine problems. A surgery was performed and patient’s uterus was removed.

Immediately after recovering from anaesthesia, the patient complained of sharp pain in her right leg. Surprisingly, tests were performed six days thereafter; arterial occlusion vessel was reported blocked.

The patient was referred to a higher centre where her right leg was amputated.

This case is an apt example of hospital’s vicarious liability. It could be held accountable for mishaps occurred in its premises by its staff.

The patient met with a road accident and sustained head injuries. She was taken to the hospital where she received treatment. She was recovering well.

Unfortunately, she fell from the stretcher and bled profusely when she was being taken to the MRI scan room. To her family’s shock, the patient died next day.

The patient suffered from kidney ailments and was on dialysis for three years. He opted for kidney transplantation; his father was the donor.

Blood oozed out of the operated site twelve days after transplantation; kidney transplant had failed. Another surgery was performed, and the kidney was removed.

The patient could not conceive and hence, she consulted the gynaecologist. Tests reported endometriosis – patient’s ovary had cysts.

The doctor performed laparoscopic surgery and removed the cysts. However, the patient continued to experience menstrual pain.

Another scan was performed; to patient’s shock and surprise, it reported multiple cysts in the ovary. She consulted another doctor, who confirmed the test reports.

The patient was consulting a gynaecologist at the hospital for pregnancy related matters. She had given birth to two babies previously with down syndrome; both had died.

The doctor advised chromosome analysis; the test reported normal findings. The patient conceived a few months thereafter, and was under regular antenatal care. Ultrasound scan was performed six times in intervals during pregnancy, each of it reported normal finding.

Unfortunately, the patient delivered a baby with abnormally formed limbs.

Onset of cancer 9 months after discharge – Hospital and doctors not negligent

The patient experienced upper abdominal pain; he consulted a gastroenterologist at a reputed private hospital. CT scan was performed; its findings were suggestive of acute pancreatitis with diffuse fatty infiltration of liver, and necrosis.

The patient was discharged after six days, he followed up as advised after six weeks. The doctor diagnosed erosive gastritis; some medicines were prescribed.

About six months thereafter, the patient again experienced sharp pain in upper abdomen and visited the doctor at the hospital. CT scan was performed; it suggested carcinoma at the head of pancreas. For some reason, the patient sought DAMA and consulted several other doctors.
