Lacking in ‘reasonable degree of skill’ – Gynec. & hospital pay INR 5 million compensation

The patient was consulting a gynaecologist at the hospital for pregnancy related matters. She had given birth to two babies previously with down syndrome; both had died.

The doctor advised chromosome analysis; the test reported normal findings. The patient conceived a few months thereafter, and was under regular antenatal care. Ultrasound scan was performed six times in intervals during pregnancy, each of it reported normal finding.

Unfortunately, the patient delivered a baby with abnormally formed limbs.
