Telangana High Court dismisses PIL against hospitals

HYDERABAD: The Telangana High Court on Thursday dismissed a public interest litigation (PIL) filed by journalist Narendhar Kazipet, seeking to direct Care and Global Hospitals to pay Rs 50 crore for alleged negligence and unethical practice assuring to increase the height of people, among other ‘dubious’ claims.

A division bench, comprising Chief Justice Hima Kohli and Justice B. Vijaysen Reddy was dealing with the PIL filed in 2016.

After noticing several medical negligence cases in corporate hospitals, the petitioner approached the court, seeking a redressal forum for the victims who suffer financial losses and anguish. In the petition, he cited negligence by Care Hospital in not diagnosing cancer in a woman who later died of the disease. He also mentioned the surgery at Global Hospital  for increasing the height of a software professional.

He urged the court to appoint an expert committee to probe into the illegalities and suggest remedies for bringing accountability in the private health system and strengthening the public health system. He also sought an exclusive mechanism to determine compensation to family members of victims of negligence and unethical medical practices.

However, the bench was not inclined to pass any directions and advised the petitioner to make a representation to the government on the issues raised in the petition.
