The Chhattisgarh high court has directed the district collector of Bilaspur to conduct a fresh inquiry into a medical negligence complaint, holding the earlier probe invalid as the committee was not constituted in accordance with statutory requirements.The petitioner had challenged two inquiry reports issued in Dec 2023 and January 2024, alleging that she suffered medical negligence while undergoing treatment for a knee-related ailment at two private medical establishments in Bilaspur.According to the complaint, a surgical procedure was first performed on the wrong knee, which had no medical issue, followed by a subsequent operation on the affected knee. She has sought action against those responsible and suitable compensation for the alleged lapse. The order was issued by Justice Parth Prateem Sahu, who noted that the inquiry team previously formed to examine the allegations did not meet the criteria laid down under the Chhattisgarh State Upcharyagriha Tatha Rogopchar Sambandhi Sthapanaye Anugyapan Adhiniyam, 2010, and the corresponding Rules of 2013.
