No medical malpractice: IAP wants cases against MP paediatrician withdrawn

There was no reason to suspect contamination," said Dr Vasant Khalatkar, national president of the IAP, who hails from Nagpur."The contamination that caused the unfortunate outcomes was a manufacturing and quality-control failure, not a prescribing error. Holding the doctor criminally liable for this tragedy goes against medical ethics and legal principles," he said.The IAP pointed out that the arrest and charges against the doctor violate the spirit of key Supreme Court rulings — including Jacob Mathew vs State of Punjab (2005), Martin F D'Souza vs Mohd Ishfaq (2009), and Kusum Sharma vs Batra Hospital (2010) — all of which hold that doctors cannot be criminally prosecuted unless gross negligence is proven.It also termed the charges filed against the doctor under various provisions of the Bhartiya Nyay Sanhita (BNS) and the Drugs and Cosmetics Act as "unwarranted and legally untenable."
